The rules and conditions for using carseto.

1. About These Terms

1.1. These Terms of Service ("Terms") govern your access to and use of the website carseto.com, including any mobile applications, features, tools, and services (collectively, the "Platform"), operated by GrowthTurn Marcin Chirowski, a sole proprietorship registered in Poland with NIP 7542694209, with its registered office at al. Zwycięstwa 241/13, 81-521 Gdynia ("Carseto", "we", "us", "our").

1.2. By accessing or using the Platform, you agree to be bound by these Terms, our Privacy Policy, our Cookie Policy, and our Community Guidelines, each of which is incorporated by reference. If you do not agree to these Terms, you must not use the Platform.

1.3. We may update these Terms from time to time. If we make material changes, we will notify you by email or through a prominent notice on the Platform at least 30 days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms. If you disagree with the changes, you may close your account before the effective date.

1.4. These Terms are available in multiple languages. In the event of any inconsistency, the English version shall prevail, except where local law requires otherwise.

2. Eligibility and Accounts

2.1. You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use the Platform. By registering, you confirm that you meet these requirements.

2.2. When creating an account, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

2.3. You may not create more than one personal account. Dealer accounts are subject to additional terms as set out in Section 9.

2.4. We recommend that you choose a display name that does not reveal your email address or other personally identifiable information. Carseto is not responsible for any consequences arising from your choice of display name.

2.5. You must promptly notify us at security@carseto.com if you believe your account has been compromised.

3. The Platform - What Carseto Is and Is Not

3.1. Carseto is an online marketplace and collector community platform that enables users to browse, list, buy, and sell classic and collector vehicles, and to build digital showcases of their collections ("Garage"). We also provide market data, valuation tools, and community features.

3.2. Carseto is not a party to any transaction between users. We do not own, inspect, certify, value, sell, resell, or guarantee any vehicle listed on the Platform. All transactions are conducted directly between the buyer and seller, and each party is solely responsible for fulfilling their obligations.

3.3. Carseto does not provide legal, financial, tax, or insurance advice. Any market data, price indices, or valuation estimates provided through our Classic Car Index ("CCI") or other tools are for informational purposes only and do not constitute professional appraisals.

3.4. While we take measures to verify user identities and detect fraud (as described in our Trust & Safety practices), we cannot guarantee the identity, credentials, or trustworthiness of any user, the accuracy of any listing, or the condition, provenance, legality, or ownership of any vehicle.

4. Listings and Vehicle Content

4.1. Seller Responsibilities. If you list a vehicle on Carseto, you represent and warrant that:
- (a) You are the legal owner of the vehicle or are duly authorised by the owner to sell it;

- (b) The vehicle is not stolen, subject to any undisclosed lien, encumbrance, or legal dispute;

- (c) All information in your listing, including description, photographs, mileage, condition, provenance, VIN or chassis number, and asking price, is accurate, complete, and not misleading;

- (d) The photographs depict the actual vehicle being offered and have not been materially altered;

- (e) You will comply with all applicable laws regarding vehicle sales in your jurisdiction, including consumer protection, tax, and registration requirements.

4.2. Prohibited Listings. You may not list vehicles that: are stolen or have unresolved title issues; contain fraudulent or misleading descriptions; infringe the intellectual property rights of any third party; or violate any applicable law or regulation.

4.3. Listing Moderation. We reserve the right to review, edit, or remove any listing at our sole discretion if we believe it violates these Terms, is fraudulent, or is otherwise inappropriate. Removal of a listing does not imply any determination regarding the listing's content or the vehicle itself.

4.4. No Guarantee of Sale. Listing a vehicle on Carseto does not guarantee that it will be sold. We make no representations about the number of views, enquiries, or offers any listing will receive.

5. Garage and Collector Features

5.1. The Garage feature allows you to create a digital showcase of your vehicle collection, including vehicles that are not for sale. Information you add to your Garage is visible to other users according to your privacy settings.

5.2. You are responsible for the accuracy of information in your Garage. Carseto does not verify Garage entries unless a vehicle is listed for sale.

5.3. You grant Carseto a non-exclusive, worldwide, royalty-free licence to display your Garage content on the Platform and in promotional materials (such as social media previews and dynamic OG images generated when your Garage URL is shared), subject to your privacy settings.

6. User Content and Conduct

6.1. User Content. You are solely responsible for all content you submit to the Platform, including listing descriptions, photographs, comments, messages, and Garage entries ("User Content"). You retain ownership of your User Content but grant Carseto a non-exclusive, worldwide, royalty-free, sublicensable licence to use, reproduce, modify, adapt, translate, distribute, and display your User Content for the purpose of operating, promoting, and improving the Platform.

6.2. Content Standards. Your User Content and conduct on the Platform must comply with our Community Guidelines. Without limitation, you must not:
- (a) Post content that is defamatory, obscene, threatening, harassing, or discriminatory;

- (b) Impersonate another person or misrepresent your affiliation;

- (c) Post spam, advertising, or promotional material outside designated areas;

- (d) Attempt to manipulate prices, interfere with other users' listings, or engage in market manipulation;

- (e) Share contact information in ways designed to circumvent Platform communication channels;

- (f) Upload malicious code, viruses, or disruptive technologies;

- (g) Use automated tools to scrape, crawl, or harvest data from the Platform without written permission.

6.3. Messaging. Our internal messaging system is designed to facilitate trust-building between users. Messages must relate to legitimate Platform activities. We monitor messages to detect fraud, scam attempts, and contact-information sharing that may indicate off-platform transaction leakage, as described in our Privacy Policy.

7. Intellectual Property

7.1. The Platform, including its design, logos, text, graphics, software, data, CCI indices, taxonomy, and all other content created by Carseto (excluding User Content) is owned by or licensed to Carseto and is protected by copyright, trademark, and other intellectual property laws.

7.2. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any Carseto content without our prior written consent, except as necessary for normal use of the Platform (e.g., sharing listings via provided sharing tools).

7.3. The Carseto name, logo, and related marks are trademarks of Carseto. You may not use these marks without our prior written consent.

8. Fees and Payments

8.1. Creating an account and basic use of the Platform is free of charge.

8.2. Certain features and services may be offered for a fee, including but not limited to: premium listing placements, dealer subscription tiers, auction services, valuation reports, and enhanced Garage features. Applicable fees will be clearly displayed before you commit to any paid service.

8.3. All payments are processed through our third-party payment provider, Stripe. By making a payment, you also agree to Stripe's terms of service and privacy policy. Your payment information is processed directly by Stripe and is not stored on Carseto's servers.

8.4. Prices are displayed inclusive of VAT where applicable. Cross-border transactions may be subject to additional taxes or duties, which are the responsibility of the buyer and seller.

8.5. Refund policies for specific paid services will be communicated at the point of purchase. For digital services purchased by EU consumers, the statutory 14-day right of withdrawal applies unless you expressly consent to immediate performance and acknowledge that you lose the withdrawal right upon full performance of the service.

9. Dealer Accounts

9.1. Professional dealers may register for a Dealer Account, subject to verification of their business credentials. By registering as a dealer, you confirm that you operate as a professional vehicle trader and accept the obligations that apply to professional sellers under EU consumer protection law.

9.2. Dealer subscription tiers, features, and pricing are set out on our Dealer pricing page. Dealer subscriptions are governed by these Terms and any supplementary Dealer Terms provided at the time of subscription.

9.3. Dealers must comply with all applicable consumer protection, distance selling, and advertising regulations in their jurisdiction and in the jurisdictions where their listings are visible.

10. Auctions

10.1. Where Carseto offers auction services, additional Auction Terms will apply and will be presented before participation. Auction Terms will specify bidding rules, buyer premiums, payment deadlines, and dispute resolution procedures.

10.2. By placing a bid in an auction, you are making a binding offer to purchase the vehicle at the bid price, subject to any reserve price. Failure to complete a purchase after placing a winning bid may result in account suspension and liability for applicable fees.

11. Trust and Safety

11.1. Carseto employs a multi-layered trust and safety system, including identity verification tiers, trust scoring, vehicle checks (VIN validation, stolen vehicle databases), and message monitoring. Details are available on our Trust & Safety page.

11.2. You may report any listing, message, or user you believe to be fraudulent or in violation of these Terms. We will investigate reports and take appropriate action, which may include removal of content, account warnings, suspensions, or permanent bans.

11.3. We are not obligated to disclose the reasons for any moderation action, except where required by applicable law.

12. Third-Party Links and Services

12.1. The Platform may contain links to third-party websites and integrate with third-party services. Carseto is not responsible for the content, privacy practices, or availability of such third-party services.

13. Disclaimers and Limitation of Liability

13.1. The Platform is provided "as is" and "as available." To the maximum extent permitted by applicable law, Carseto disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13.2. Carseto does not warrant that the Platform will be uninterrupted, error-free, or secure, or that any defects will be corrected.

13.3. To the maximum extent permitted by applicable law, Carseto's total aggregate liability to you for any claims arising out of or relating to these Terms or your use of the Platform shall not exceed the greater of: (a) the fees you have paid to Carseto in the 12 months preceding the claim; or (b) EUR 100.

13.4. Carseto shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages.

13.5. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.

14. Indemnification

14.1. You agree to indemnify and hold harmless Carseto, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Platform; (b) your User Content; (c) your violation of these Terms; (d) your violation of any third party's rights; or (e) any transaction you enter into with another user.

15. Dispute Resolution

15.1. If you have a dispute with another user regarding a transaction, we encourage you to first attempt to resolve it directly. Carseto may, at its discretion, offer mediation assistance but is not obligated to do so and is not a party to any such dispute.

15.2. If you have a dispute with Carseto, you agree to first contact us at legal@carseto.com to attempt an informal resolution. We will endeavour to resolve your complaint within 30 days.

15.3. If informal resolution is not possible, you may bring proceedings in the courts of Warsaw, Poland, without prejudice to any mandatory consumer protection rules in your country of residence that grant you the right to bring proceedings in your local courts.

15.4. EU consumers may also submit complaints through the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

16. Termination

16.1. You may close your account at any time through your account settings or by contacting us at support@carseto.com.

16.2. We may suspend or terminate your account immediately if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or pose a risk to other users or the Platform.

16.3. Upon termination: (a) your right to use the Platform ceases immediately; (b) we may retain your data as required by law or for legitimate business purposes as described in our Privacy Policy; (c) any outstanding fees remain payable.

17. General Provisions

17.1. Governing Law. These Terms are governed by the laws of the Republic of Poland, without regard to its conflict of law provisions. This choice of law does not deprive EU consumers of the protection of mandatory provisions of their country of habitual residence.

17.2. Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17.3. Entire Agreement. These Terms, together with the Privacy Policy, Cookie Policy, Community Guidelines, and any supplementary terms, constitute the entire agreement between you and Carseto regarding the Platform.

17.4. Assignment. We may assign or transfer our rights and obligations under these Terms. You may not assign your rights without our prior written consent.

17.5. No Waiver. Our failure to enforce any provision of these Terms shall not be deemed a waiver of such provision or our right to enforce it in the future.

17.6. Force Majeure. Carseto shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control.
